Booking and acceptance

These Terms apply to performance and entertainment services supplied by The Sax Guy LTD (“we”, “us” or “The Sax Guy”) to the person named in the booking confirmation (“the client”).

A website enquiry or estimate does not reserve a date. A booking is secured only after we have confirmed availability and the client has accepted the final quote, agreed to these Terms and paid the requested deposit. By paying the deposit, the client acknowledges and accepts these Terms.

The booking confirmation, final quote and these Terms together form the agreement between the client and The Sax Guy LTD.

Deposit, payment and travel

A deposit is required to secure the performance date. The deposit amount will be shown in the final quote and will not exceed 20% of the quoted total.

The deposit reserves the date and is non-refundable if the client cancels, except where these Terms or applicable law require otherwise. It is credited towards the total booking price.

The remaining balance and its payment deadline will be stated in the booking confirmation or invoice.

Travel expenses are calculated using the round-trip mileage to the venue. Any travel or accommodation amount included in the final quote forms part of the booking price.

Cancellation by the client

The client must tell us in writing as soon as possible if they wish to cancel. The following cancellation charges apply:

  • More than three calendar months before the event: no further cancellation charge will be due, but the booking deposit is retained.
  • Between one and three calendar months before the event: 50% of the total quoted price is due, with amounts already paid credited against that figure.
  • Less than one calendar month before the event: the total quoted price is due.

Cancellation charges are intended to reflect the losses arising from holding the date, preparation already carried out and the reduced opportunity to accept another booking. We will take reasonable steps to reduce those losses. Where we avoid costs or secure a replacement booking for the date, any amount retained or due will be adjusted where required by law.

If the client has paid more in advance than the fair cancellation charge, the balance will be refunded. Paying the full price early does not remove any refund rights the client may have under applicable law.

A request to move the booking to a different date is subject to availability and written agreement. If a suitable replacement date cannot be agreed, the request will be treated as a cancellation.

If Guy cannot perform

If illness, a family emergency, an exceptional life event or another circumstance outside reasonable control prevents Guy from performing, we will first try to find a suitable saxophonist who can fulfil the booking. The agreed performance fee will then be passed to that replacement.

If a suitable direct replacement is unavailable, we will ask a reputable entertainment agency to accommodate the booking. The client will not be charged more than the agreed price without their prior agreement.

If these safeguards have been exhausted and no suitable replacement can be provided, the booking will be cancelled and all amounts paid to The Sax Guy LTD for the affected services will be refunded.

Conduct and performer safety

The services are designed to create a full party experience, but performer and guest safety must come first.

If a client or guest behaves in a threatening, abusive, violent or particularly aggressive way, the performers may pause or end the performance where they reasonably believe this is necessary to protect themselves, another performer, venue staff, guests or equipment.

Where practical, the client or venue will be given an opportunity to resolve the situation before a performance is ended. This will not be required where there is an immediate safety risk.

Equipment damage

The client is responsible for taking reasonable steps to prevent guests from interfering with performance equipment.

If equipment is damaged intentionally or accidentally by the client or one of their guests, the client may be responsible for the reasonable cost of repair or replacement. This does not apply to fair wear and tear or damage caused by a performer’s negligence. We will provide evidence of any material damage and the reasonable cost claimed.
